The Development Services Department facilitates and implements planning policy and development services, including building activities.  The focus of this Department is:

  • The review and processing of development applications, including minor variances.
  • The review and issuance of building permits (See Below - Why Building Permits are Required)

Planning Process

Official Plan

The Official Plan reflects a community vision for future change and development and outlines in a broad manner the land use and development guidelines for Uxbridge.  Generally, the Township of Uxbridge Official Plan guides growth and development within the urban limits of the Town of Uxbridge.  The Durham Region Official Plan guides land uses within the rural areas of Uxbridge. The Official Plan is implemented through the Zoning By-law.

Zoning Bylaw

The Zoning Bylaw implements the policies and objectives detailed in the Official Plan. It outlines how a specific parcel of land may be used and regulates matters such as lot size, parking requirements, building height, landscaping requirements and other site-specific factors.

If an applicant wishes to develop a property in a manner that deviates from the current zoning provisions, they must apply for a Zoning By-law Amendment; also referred to as a rezoning. For example, a change of use from residential to commercial would require a Zoning By-law Amendment.

Sometimes a property owner only wants to make a minor deviation to the Zoning By-law provision such as a building setback or height restriction. This can be done by applying to the Committee of Adjustment for what is known as a minor variance. For example, a property owner planning an addition onto their house determines that with the addition there will only be a 6.5 meter rear yard. The Zoning By-law requires a rear yard depth of 7.5 meters. This is a minor deviation, and the owner could apply to the Committee of Adjustment for a minor variance that if approved would relax the rear yard requirement under the Zoning By-law and allow for the addition to proceed.

Site Plan Approval/Site Plan Agreement

This is a planning review process that examines design and technical aspects of a proposed development. Site plans provide detailed information about development plans for a specific property. For example, site plans describe the location of parking, property access, building details, including elevations and landscaping details. Site Plan Approval concludes in a site plan agreement registered on title to the property.

Building Permits

Why are Building Permits Required?

Building permits are required to ensure all buildings are constructed in a safe manner. Building permits are reviewed in accordance with the Ontario Building Code. Building permits are required for new buildings, additions, renovations, demolition, decks, sheds, accessory structures, farm buildings. It is unlawful to start construction or demolition before you have a building permit.

Building Permit Applications

If you are planning on building, contact the Development Services Department and speak with a Building Inspector. The Building Inspector can walk you through the process.

Building permit applications are available at the Township of Uxbridge offices. Every building permit application must be accompanied by at least 2 copies of the plans, specifications and the permit fee. Permits will be reviewed for compliance with the Ontario Building Code. It may be necessary to obtain approvals from other agencies prior to the issuance of the building permit. Please speak to a Building Inspector to determine whether approvals from other agencies are required.

Building permits are not required for new buildings with a building area less than 10 m2.

In most instances, the cost of a building permit is based on the area of the building. However, there are some cases where the building permit fee is fixed. Please refer to the Township of Uxbridge fee schedule for applicable fees.

Single Family Dwelling Standard Fees

Please note that other fees may be required depending on lot location. This information is provided for general purposes only. Please contact the Building Department for current requirements.

In addition to the above a $1,000.00 performance bond shall be required for each new residential dwelling unit to be constructed. Said performance bond shall be refunded (without interest) to the permit holder provided the dwelling units(s) is completed within two (2) years of the date upon the permit was issued.

Refund Of Permit Fees

  • 75 percent if administrative functions only have been performed
  • 60 percent if administrative and zoning functions only have been performed
  • 45 percent if administrative and zoning and plans examination have been performed
  • 35 percent if the permit has been issued and no field inspection that have been performed subsequent to permit issuance
  • 5 percent shall additionally be deducted for each field inspection that has been performed after the permit has been issued

If the calculated refund is equal to or less than the minimum fee applicable to do the work, no refund shall be made of the fees paid.

Committee of Adjustment Minor Variances

What you should know?

1. The Committee

The Committee of Adjustment is comprised of five (5) members and a Secretary/Treasurer. The members are appointed by Council for the four-year term and the authority to create a Committee of Adjustment by the Township is set out in the Planning Act a Provincial Statute. The current Committee is as follows:

2. Purpose and Powers of the Committee

The owner of a property who is unable to comply with the provisions of  Zoning By-law 81-19, as amended, may apply to the Committee by means of an "Application for Minor Variance" to seek relief from the Zoning By-law. Section 45(1) of the Planning Act notes that a minor variance may be granted provided that, in the opinion of the Committee, the request is; minor in nature, is desirable for the appropriate development or use of the land, building or structure and the general intent and purpose of the By-law and the Official Plan is being maintained. Any authority or permission granted by the Committee may be for such time and be subject to such terms and conditions as the Committee considers appropriate.

3. The Process

The Application: If you wish to apply to the Committee of Adjustment, you must complete an application form, which is available from the Building Department.

The Notice of Hearing:

Upon receipt of a completed application and fee, staff then prepares a Notice of Hearing which among other things describes the details of the requested variance, the date, time and location of public hearing. The Notice of Hearing is mailed to every property owner within 60 metres (200 feet) of the subject property and notice is provided to Township Planning Committee as well as outside agencies such as Health Departments and Conservation Authorities. Parties that receive notice may either attend the hearing or submit written comments which will be read at the hearing.

Viewing Application and Plans:

If you wish to review the application or any plans submitted with the application they will be made available prior to the hearing in the Development Services Department or by contacting the Secretary of the Committee Emilia Gruyters at (905) 852-9181 ext. 212.

Inspection by Committee Members:

It is common for one or more Committee members to visit and view the subject property prior to the hearing.

The Hearing:

- The Chairman will inform those attending that if they wish to receive a written copy of the decision, to leave their name and postal address.
- The Chairman will read the request for minor variance being sought.
- The Applicant or Authorized Agent will be requested to present his reasons for not being able to comply with the By-law and their reasons justifying the request for variance. The applicant must be present or have a duly appointed agent at the hearing to present the application to the Committee.
- The Chairman will read any written comments provided by outside agencies.
- The Chairman will invite questions and comments from any other parties in attendance.
- The Committee will be given an opportunity to ask questions of the applicant.

The Decision:

The Committee will make the decision in public after all discussions regarding the application is completed, then the Committee will hear the next application. The Applicant and anyone who indicated they wanted a written copy will have a copy sent to them by mail within 10 days. All decisions are subject to appeal within twenty (20) days from the date the decision is made. At the end of the twenty-day period, if there has been no appeal filed with the Secretary/Treasurer, the decision will become final and binding and a notice to that effect will be issued.

Appeal Provisions:

During the 20 day appeal period, any person having an interest in the application may file an appeal of the decision to the Ontario Municipal Board. The notice of appeal must be in writing and sufficiently outline the reasons for the objection and shall be submitted to the Secretary/Treasurer of the Committee along with a $125 cheque payable to "The Minister of Finance" prior to the expiry of the 20 day appeal period.

Other Costs:

It is not uncommon for the Committee's approval to be conditional on the applicant being required to enter into a site plan agreement with the Township and/or to have restrictions registered on title of the subject property. These legal and related costs for preparation of agreements are for the account of the owner/applicant and shall be paid to the Township when invoiced.
